situation and we have the police report in front of us today so we're going to what we're going to go over the police report break it down because the police report is different than my video because it's not my perspective it's both parties perspectives correct correct and then that comes together sorry not to K off with also the police perspective or is it just they document both sides and put it in the report they document both sides and they do kind of give their own perspective on what happened to one of the individuals in the case oh okay cool so we have that and then what we have is we have something over here yes so we also have the official Complaint here as you can see Superior Court State of California Orange County we have here Damon frier daily G Exotics plainst we have five causes of action here so as you can see things are ready to go we are are ready and it's time for everyone to lawyer up we're taking this very very seriously and all these guys are in a lot of trouble so in the police report it has that fire stated that he apologized to one of the parties and um that you were continuing to yell and that you asked one of the parties how fast you were going and you exited your vehicle and started recording the incident one of the parties won't necessarily say their name but it was the person in the green shirt he continued to yell profanities profanities at you he walked in the southwest direction away from your vehicle you continued to record and while recording he continued to yell profanities then you heard the sound of glass breaking coming from behind you you looked back towards your vehicle and saw a male wearing a black clothing and he was walking away from your vehicle with a sledgehammer and it has here the estimated damages to the windshield is approximately $5 to $110,000 so you walked back over to your vehicle and saw the windshield had been broken and you called the police to report the vandalism which is exactly what happened the police came to the incident and located one of the individuals who matched the description that you provided the person who vandalized your vehicle is a construction worker and he was currently working at the residence and the following is a synopsis of what he had to say this is the person who smash the windshield right okay so this is going to be what he says to the police officers correct interesting cuz I think in our video we did the best we could by turning the audio as loud as we could and what we heard we put in some subtitles which basically before you read it he said from what our understanding was he said that the car showed up with the broken windshield yeah yeah and and that's such a great Point that's exactly what he said and often times people think that in order to go after an individual you need to have either video footage of him directly hitting your car with the sledgehammer or you need the CSI effect DNA samples hair samples blood everything and you have experts to evaluate the damage to the windshield to make sure that it was that exact sludgehammer that did it none of that is necessary we actually could have done that the CSI effect we could yeah itely help necessary the perfect imprint to that Sledgehammer usually we get experts involved to evaluate stuff like that but instead of doing that there's what's known as circumstantial evidence where the court looks at the surrounding circumstances and facts and draws a reasonable conclusion from those facts so what we had was the sound we had him walking away with the sludgehammer and we had the before and after video footage so that's a big one and not to mention the scene where he hides the sledgehammer oh and that and they all lie right right and we'll we'll get into that okay the person who smashed your windshield he was eating lunch with his coworker which is what we saw um in the back of the commercial truck he saw your Lamborghini driving down the street at a high rate of speed the Lamborghini was then seen driving up Northbound back towards an individual on this truck the Lamborghini was approximately 5 ft away from the tailgate where he was eating he stated that the broken windshield was already there now I want to pause here knowingly lying to to a police officer is a crime oh it is it is a crime the sad part about it is that the only time something actually happens as a result of lying to the police is for things like false identification so knowingly providing false identification to a police officer that's normally when you see charges but that doesn't take away from the fact that knowingly lying to a police officer is a crime we know that he's lying obviously this person saw the person in the green shirt walk into the street and stop the Lamborghini that person in the green shirt told Damon to get out of his car and the two got into a verbal argument which is true that's interesting so he now is a witness for us cuz he confirms I was stopped in the middle of the road I didn't just stop on my own and also he confirms that the guy before I could get my camera open yeah the guy was telling me to get out of the car it he literally said that person in the green shirt walked into the street and stopped your Lamborghini this person who hit your Lamborghini admitted that he had the sludgehammer in his hands but did not use it to smash your window this person's lunchtime was over and he got back to working on the construction of the house and this concluded his statements so I want to reiterate again we are coming after these guys they are not off the hook something like this is taken very seriously you don't want to do what these guys did and we'd love to give you guys some more details on the complaint but we'd rather wait for these individuals to see this paperwork in front of their face and then we'll update you guys from there what else we got on that police report so we got the person person who was wearing the beanie give a report as well so according to his statement he was driving his truck Northbound on the street and turned left onto his neighbor's driveway he was then reversing out of the driveway and saw a blur go down the street he stated that the car was traveling at approximately 65 mph and weaved through cars that were on the street he then saw the person in the green shirt get into a verbal argument with you and that he was unable to see if the Lamborghini had damages the windshield already and that concluded his statement so hold on yeah back it up for a second let's back that up if we went back to the video that was like a one car at a time road because of all the traffic that was parked along either side of that road and I know that cuz I drove down it twice cuz I drove down once and then I had to go down I ended up in a CU a sack and I had to turn around and come back and that's when I actually got stopped and he almost makes it sound like I went speeding down the road and then the guy in the green stopped me like I went several blocks before I ever came I didn't go down just turn straight back so we'll read that again diss that but first of all he said I weaved in and out of out of traffic down this road and at 65 that is so ridiculous it's not even funny like if you were to drive 65 M an hour down that road with traffic on either side had complete that would be so dangerous well first of all you would be stop in time in front of you you wouldn't stop for the stop sign of the end cuz it's like 5,000 down the stop sign so there's no way you can doing 65 mph that's that's fast also apparently he saw you driving at 65 mph and weaving through cars while he's reversing out of a driveway so all of this is it was a blur but he saw me weaving in out of cars correct and then we have the guy in the green shirt statement as well he stated he was standing in front of one of the homes he was working outside when he saw your Lamborghini traveling at approximately 50 to 60 MPH southbound he then saw the lambor the Lamborghini traveling Northbound towards his Direction he got in front of the Lamborghini and stayed to the driver which is you you have to slow down then you started to record the situation and exited your vehicle the guy in the green shirt walked towards his house and he was unable to see if the damage to your vehicle was already there and then his wife told him to go inside of the residence because the situation was getting escalated and his wife called the police did he just say that he walked in front of the car the stoping to talk to him he says that he well it says he walked in front of the Lamborghini and stated to the driver you have to slow down he said I walked in front of it but then he said that he couldn't tell when when she was was damaged or not he said he couldn't tell if the windshield was damaged or not so the police officer he walked over to your car he examined the damages took photograph all that's documented in there and he formed the opinion that the person who smashed the windshield of your Lamborghini was in violation of vandalism not just vandalism felony vandalism because so they actually arrested him they did arrest him and they took him to jail walked over to the person who vandalized your car handcuffed his wrist behind his back and double lock them and place them under arrest that's good and we're currently getting in contact with the district attorney to see if they're going to pursue the charges against this man I think we all want to know if the legal system works some people feel like they can't trust that process and maybe it's a misunderstanding you got to understand this is black and white there's no gray area it's like you have to have evidence that's how people get convicted of a crime you can be charged of a crime but there's a difference between charged and convicted conviction is when you've been proved of the crime everything up until then is you're innocent until proven guilty right that's correct and I think some people need understand that like in this case we have the evidence now we need to find out if they're actually going to pursue it and we're still not done with the police report we have one more party who gave a statement and I must say this is my favorite part really this is my favorite part who's the party so we have the um the green shirts wife statement to the police and um she said that she was watching the whole incident from her patio and stated that you started to antagonize the antagonizing you she she made it seem like everyone else was the victim except for you when which is clearly not what happened course you know what the good piece is in all that is like hey whoever
